How can I remove the “Blog at WordPress.com. | Theme: Toolbox by Automattic.” and the wierd smiley from the bottom of my blog?
If it’s something that has to be there due to legel issues, can I create my own template then?

You can’t – that is required even for the VIP blogs that start at $ 20,000 a year costing – if you remove or change the footer your site can be suspended.

You can add to it, but you can’t remove the WP.com text or the credit for the theme designer. And at WP.com you can’t create your own theme, for technical reasons.

No – that is part of the Stats tracking system.
You can always get a refund (from your dashboard >> stores) and move to a WordPress.ORG install.
