Blog Plagarised and DMCA not doing anything about it.

    I reported someone who at first reblogged my blog, then some time later removed the reblog and wrote a blog entry using several sentences directly from my own blog. Clearly plagiarism.

    I’ve done some checking on Copyscape and I can see they are doing this to others too, same thing, reblogging to start with then removing the reblog and putting a new entry with plagiarised content and no link to the original blog or any reference to the original author.

    What is annoying is I filed a DMCA complaint and I had a response today saying this was ‘fair use’ which I believe it definitely is not.

    I’m hoping someone at Word Press support can see the common sense here and hopefully put a stop to this or at the very least have my entry removed from their blog.

    This has really taken the pleasure out of using Word Press for me.

    Anyone can quote your and correctly attribute the quote to you and that’s not plagiarism.

    In determining whether the use made of a work in any particular case is a fair use the factors to be considered shall include – (1) the purpose and character of the use, including whether such use is of a commercial nature or is for nonprofit educational purposes; (2) the nature of the copyrighted work; (3) the amount and substantiality of the portion used in relation to the copyrighted work as a whole; and (4) the effect of the use upon the potential market for or value of the copyrighted work.     But that’s the point, they haven’t attributed it to me or quoted me. They’ve simply ripped sentences out of my blog and published them as their own work.

    Like I said, at first they ‘reblog’ then they ‘remove’ the reblog and publish it themselves as their own work with select sentences.

    In fact these matters are not discussed on public support forums. They are discussed by email with Terms of Use Staff after completing complaint forms and DMCA notices http://automattic.com/dmca-notice/ http://en.wordpress.com/complaints/ so Support Staff will simply close this thread and you can proceed by use of those means.

    As I’ve already mentioned, and the whole point of this thread is that the DMCA complaints procedure hasn’t dealt with this properly. This is why I’m bringing it to the public forum and hopefully, as I’ve seen with other threads where they have dealt with these issues that they will deal with it rather than just close the thread, or at very least contact me to deal with it properly rather than sweep it under the carpet.

    The public do not make policy. Support Staff do not make Terms of Use policy. The only arbiters of Terms of Use policy and DMCA takedowns are the Terms of Use Staff.

    As timethief indicated, we cannot address DMCA complaints in these forums. For legal reasons, the *only* way to file a complaint with us about copyright infringment is to submit a DMCA notice by following the instructions at http://automattic.com/dmca-notice/ . Note that this will work only if the other site is hosted on WordPress.com; if the site is hosted elsewhere, you will need to contact the appropriate hosting provider, as we have no control over those sites.
