Can a controversial blog be deleted by WordPress?

    I have recently written a very controversial blog and am wondering if WordPress can delete it if the party it regards complains. The blog is very damaging to the individuals reputation, but the blog is fact based. The blog is located at http://desireedevine.wordpress.com/2009/05/26/lisamarie/

    Read the ToS or contact staff directly. The laws of the United States apply to WordPress blogs.

    This is really something that you need to take up directly with staff since they are the only ones that can say for sure.

    In the past, there have been posts, and even entire blogs, deleted due to illegal or criminal acts or content. WordPress takes this stuff very seriously.

    And it wouldn’t hurt to get some legal advice from someone qualified, whether you pay for it or not. I had a REALLY controversial post about a serial killer, and WP stuck by me, but the sheer number of threats of legal action was scary. It did me a lot of good to talk to a cop and a lawyer who could tell me what the realistic situation was.

    Yeah, a very good idea Rain, the OP I’m sure would not want to spend time in prison, or get involved in a big defamation lawsuit.

    Or, as in my case, lose nights and nights of sleep over threats that turned out to be hollow.

    …make sure to also monitor the comments for anything libellous, threatening or slanderous.

    If someone just says “Close that blog it’s horrible” nothing happens.

    If someone gives very specific information about a post and it is decided that your post needs an alteration we would get in touch.

    Words like “allegedly” are very useful.

    And as feartheseeds says – watch and if necessary edit comments.

    Bear in mind that using images, complete emails or videos that are or could be owned by the other party could mean they have to be removed. This of course applies to any posts.

    I’m surprised my blog is still standing and I’m still here. Though I have been threatened but I say it’s not like I pull this out of my ass and make it all up. Then someone told me to say allegedly more often which I didn’t want to but I have recently. I also write Opinion/Editorial at the beginning of what I write. I just started doing blind items and for the first time placed my version of a disclaimer. Just don’t post real names or that kind of personal information. Well that’s what I do since most in the industry I blog about have stage names. Someone also told no one will sue me because I don’t make any money from this or have ads or affiliated with any company. Though someone who I despise is being sued for $3 million for libel! hahaha

  • We get a lot of complaints claiming defamation or libel. Most of them can’t even spell those words. Almost none are aware of 47 USC section 230.

    When you’re writing something controversial on your blog, qualify your statements and source your quotes carefully when attributing words or deeds to someone. Don’t post using someone else’s name, and be aware of your copyright and trademark obligations. Don’t expect us to act as a free legal defense team.

    If you need to make a complaint, please be brief and specific. Don’t treat us as a cheap substitute for the legal system – that’s what courts and lawyers are for.
