Catch22? Between Updating and Backing up?

Hi all, I’m working with a client advising them on developing e-commerce and sales strategy for thier artwork and notecards, they have a WordPress.com site, but it has not been core or plug-in updated for a long time, and I suppose as a result, now contains some sort of spam bug that is replacing words such as menu items, with long lines of random text. Since I am not a website developer I don’t have much insight for him, we have tried backing up, which it looks like we did with the database, but have been having problems backing up the files. Any advice? Should we just go ahead and attempt the core update? The download backup doesn’t seem to be working, I’m going to assume that may be from the fact that the backup plug-in also wasn’t updated. SO are we in a catch22 here? Unable to backup due to not having updated, and afraid to update because we might lose the files that we can’t backup?

All WordPress.com site either active or inactive are always running the latest version of WordPress and are regularly checked for malware.
Can you please let us know the address of your client’s site to make sure it is hosted by us?
