The funniest thing is that, if you turn on the Internet, the vast majority of italian blogs and sites (except “Blogger”) are not at all adequate. Probably the majority of directors do not even know that this law exists. Maybe we’re exaggerating here in concern, especially as it seems unlikely that anyone is going in and denounce the guarantor one of the millions of Italians Blog (in 2011 were 156 million!).

Il banner deve specificare che il sito utilizza cookie di profilazione, eventualmente anche di “terze parti”, che consentono di inviare messaggi pubblicitari in linea con le preferenze dell’utente.
Deve contenere il link all’informativa estesa e l’indicazione che, tramite quel link, è possibile negare il consenso all’installazione di qualunque cookie.
Deve precisare che se l’utente sceglie di proseguire “saltando” il banner, acconsente all’uso dei cookie.
Secondo me:
Tu hai dato con il banner l’informativa breve. A questo punto l’utente ha due scelte: o abbandona il sito o, se continua la navigazione, ACCETTA implicitamente l’uso dei cookies (cosa che è prevista dalla legge). Dato che noi non possiamo utilizzare il tasto OK e men che meno tener traccia della scelta degli utenti perchè l’utilizzo di java-script in WP.com è inibito, penso che di più non possiamo fare. Il banner non scompare (e non è richiesto che scompaia, ma solo che possa scomparire dietro azione attiva dell’utente), il navigatore è subito informato dei cookies e, se continua, accetta. Il problema, ripeto, non è il banner, ma l’informativa estesa: cosa ne sappiamo noi di quali e quanti cookies vengono installati navigando sui ns. blog? E’ qui che WP dovrebbe intervenire fornendo un’informativa generale come ha fatto, per esempio, blog-spot (ho visto il tuo blog, ma WP è un’ltra cosa!!).
Inoltre dobbiamo tener presente che, come tutta la normativa sulla privacy, difficilmente il garante si attiva d’ufficio. Quindi dobbiamo sperare che non ci sia qualche stronzetto imbecille che, volendo farci del male, faccia una denuncia. -

Here in the Netherlands it’s more or less the same. I’ve seen some websites making good fun of the law by displaying a super-large, extremely annoying, advertisement-style mega-banner which covers the entire page and explicitly thanks the Dutch authority for this “smart” idea. :D

By the way, no, that doesn’t work. If you want to follow the law strictly you cannot insert the cookies before the user accepts. That is of course super inconvenient and basically means that every european website needs to be modified to change all the front-end logic of the pages. Of course Europe doesn’t pay for this work. ;) So you can add how many notices you want, but it won’t save you.
Things are a bit different for technical cookies rather than tracking cookies, those require information but not explicit consent.
WordPress.com is not located/based in Europe.
Precisely why I host my blog here and some other websites on a VPS in Canada. But still, this does not prevent the authority from possibly punishing you since you are based in (and running the website from) Europe.

Fate presente che avete un blog su wordpress.com e vedrete cosa vi dirà.
A me ha detto che dobbiamo stare tranquille perché a breve uscirà un aggiornamento di questa legge. Mi ha detto comunque che i blog su wordpress.com non richiedono iscrizioni o dati sensibili e non utilizzano determinati cookies.
Ho fatto presente che ho inserito l’informativa sul blog in quanto siamo impossibilitate ad inserire un banner e anche loro sostengono che appoggiandoci a wordpress.com é l società che deve mettersi in regola.
Mi ha detto di stare tranquilla perché non é proprio così come leggiamo su internet. Mi ha anche parlato che i siti interessati sono quelli che richiedono iscrizioni con dati sensibili.
Vi invito a chiamare anche voi il numero 0669 6772917 e sentire con le vostre orecchie ciò che vi verrà detto.

You are worrying more than you should.I have placed on my site a text widget which informs about the cookies and all others stuffs and bla bla bla…
If someday i will receive a warning about my site not being aligned with the law i will turn the problem to wordpress.com.
We are just users of service. Cookies and policies must not bother us.
Otherwise would have choose a private dedicated hosting were you are fully responsible of your contents.Imho :)

I should try it to answer. Anyway, this solution gives you a code to be c’n’p in your website’s HEAD, something you can’t do with a free wordpress account.

If my translation is correct, this is not an issue that the majority of WP’s end-users (simple bloggers like me) need to worry much about and I’ll rely on WP’s professional standards to ensure compliance when and where necessary.

I was thinking very much the same, that stating that a website uses cookies is very much stating the obvious and being legally required to post a banner to that effect is a meddlesome regulation too far, particularly for such as ‘bloggers’ who do not collect any data for their own use. -
I’ll leave the blog visibility on “private” anyway.
If it is only for the cookies, don’t worry… you are still using cookies. :P

How is it possible that people are so naive that they think they have a fine, when they have no guilt?
Put the widget side as said WordPress and the information page. Then if WordPress will have a fine, that’s their choice!
