Copyright laws

Hi there. I tried to submit something in the public forum, but didn’t get a response, so I hope this is okay. I have had my WordPress blog for many years, but only recently became a viral type writer. To be honest, I wish I hadn’t as people are stealing my things. Recently another published author alerted me to my blog post that was stolen. I followed your protocol and alerted the site to take it down. In fact, they claim they will if you ask them. Not so, she edited my material and claimed she wrote it and that it is now hers. It still reads like mine…and she has done this all throughout her ‘blog’. Which is nothing but content scraped from other sites. Here is the one she took from me: http://mysticalraven.com/health/2522/15-things-youll-notice-when-youre-in-the-presence-of-an-empath When I notified her, as she used the same title before, she added 5 more things and claimed to have taken my content out: http://burnedhand.com/10-things-you-notice-near-an-empath/ It still reads very much like mine and even starts off with her fake beginning like she is having the same experiences I am. Do I have any rights to this as she is making money from ads? This is a high ranking post on my page and I recently sponsored it on FB which is how I believe she found it. Thank you!

  • Hi there,

The site, mysticalraven.com is not hosted with us but by GoDaddy, and burnedhand.com is hosted with SiteGround, so we have no control whatsoever over those sites or any content posted on them.

We are only able to act against sites if they are hosted with us, so to have content removed from those sites you’ll need to contact GoDaddy.com and SiteGround.com respectively.

Both those sites will most likely require you to submit a valid DMCA takedown notification before they’ll be able to remove that content. You are welcome to use our DMCA takedown form as a template to write your own takedown request to those web hosts:

Copyright Infringement – What to Do

Whether you’re entitled to any compensation for the ad-income they’re making from your content will be for a court to decide, should you decide to take legal action against those people that go beyond a takedown request. However, if you can identify who their advertising partner is (for example, Google Adsense) you can also report their content theft to the advertisers directly as it’s most likely against the advertiser’s terms of service as well.

I am theburnedhand.com and it is my property…I did contact Go Daddy but at the bottom of her page it says powered by WordPress?? Also, I moved from WordPress free to WordPress paid…so it doesn’t matter, it’s who it’s hosted by then?

  • I moved from WordPress free to WordPress paid

You didn’t. You moved from WordPress.com, the blogging platform, to a self-hosted WordPress.org site. Self-hosted sites use the WordPress software which is not controlled by us, and we don’t have any access to self-hosted sites, nor do our terms of service apply to self-hosted site. WordPress.com and WordPress.org are completely separate and different.

If a site says Powered by WordPress at the bottom, it means they’re using the self-hosted software – if you hover your mouse over the WordPress you’ll see it links to WordPress.org. All sites hosted on WordPress.com will say WordPress.com instead of WordPress, and link to us, not the .org site.

    WordPress.com and WordPress.org

For a self-hosted site you are bound by the terms of service of your hosting provider, which is Siteground in your case, and GoDaddy in the other site’s case. Our policies don’t apply to either of these sites, as they’re not hosted on our servers.

So only GoDaddy can help you in this case, as they are the other site’s host. But they will be bound by the DMCA, so will have to respond if you submit a valid DMCA takedown notice.
