Copyright of work or just a derivative?

  I have recently started tampering with wordpress, I tried creating my own theme initially, but as I understood this was the hard game to start my way with, I decided to use a theme provided my a magazine and customize it to my hearts content!!

  So, after I changed most of its graphics, some of its structure and added my posts and logo to use as a personal portfolio, I wondered how much could this work be considered a copy and how much this work is considered a derivative work, which could possibly be signed under creative commons
