Do I need legal permission to use a photographer's picture as my header?

I’m using Hemingway Rewritten (great theme), and I am in the market for a new header photo. But I’m concerned that photos I find online are copyrighted. Do I need permission in order to use photos (from Flickr, for example) on my blog? Will I be penalized for using a photo other than my own?

Using any image you do not own without the express written permission of the copyright holder is a a copyright violation.
