do you need permission to post someone else’s Flickr photos?

Do I have to have someone’s permission before I post their photos from Flickr onto my blog? I would of course put a caption and link that would send my readers straight to their Flickr Page, so I would think that would be good enough. I have tried to contact some of the owners of the photos to ask for permission, but no one writes back. I’ve seen Flickr photos on other peoples’ blogs, so I’m wondering what gives?

Unless it’s a creative commons or other freely licensed photo you do need their permission, otherwise it’s copyright infrigement. Does everyone do this? No, but that doesn’t make it right. I make sure that all photos from flickr used on my blog are creative commons licensed. They have a search mechanism to search for such photos easily.

Creative Commons licenses also vary quite a bit so check the terms of each photo

Flickr is great in that they have licenses posted for each photo. Most people use the All Rights Reserved, though, which is the default, and in that case you’d have to drop a comment and ask them directly for permission.

I’ve also seen historical photographs incorrectly labeled “all rights reserved” and in that particular case re-educated the Flickr poster about what his rights to somebody else’s photos actually were. He was not well pleased.

It is common to take whatever you want from Flickr, on the grounds it’s a photo-sharing site, but it’s not legal and since the licenses are posted right there on the page, it would be completely immmoral to ignore that. Besides which, Flickr users are pretty proactive about going after bloggers who just use their stuff. Always best to ask.

I am a flickr user, and WP blogger.

Yes, you must ask to use my photos, as I have them All Rights Reserved. Will I allow you to use my photos on your blog? Most likely, unless you are somehow making money off of them – in which case you can definitely use them, provided you cut me in.

Unlike a lot of flickrites, I do not visibly watermark or post logos on my photos, and I upload pretty high resolution versions, and allow people to download them. This may change in the near future. I haven’t decided.

There are some good answers above this, but I figured I’d chime in for what its worth.

Oh, and do we know when you have used our photos or a link to them? Of course. Flickr shows us stats on a lot of stuff, and we definitely know when someone has blogged a photo, or even a group of photos that our photo is a member of.

Its usually pretty easy to email a flickrite and ask for permission – we all like the exposure…
