Does my theme/template have a comment bug?

My blog is http://fightingwindmills.wordpress.com I use the theme/template Tarski by Benedict Eastaugh and Chris Sternal-Johnson. I sometimes see that comments people have previously made on other posts end up attached to a different post. For example, if I write a draft and click “preview” there are almost always comments from another post of mine at the bottom of this new draft post that I have not yet published.
The problem is not just when I am writing drafts. Sometimes people want to comment on a certain post, and their comment ends up in the wrong place. Then I have to email them and ask them to please comment again. Otherwise their comment does not make sense because it is out of context. I have looked for a way for me to click edit and change the post which the comment is attached to, but I have not been able to. I can change other things with the edit feature, but not which post the comment belongs with. This has happened 5 times that I know of in the last 2 months.
I would like to know if it is a problem other people who use the Tarski theme are having. Is there a bug in the code?
I know of one other person with the Tarski theme and I have noticed that her blog had the same issue today. I clicked on a post and saw 8 comments from another post. If I had commented under those, my comment would have gone into the wrong post. Her blog is http://seaswell.wordpress.com I would appreciate it if someone could look into this problem. This sounds like a problem that only staff can sort out. Perhaps one of them will see this this weekend and take a look. If they don’t, contact them on Monday.

Nevermind, I found out that I need to upgrade my tarski theme. I will work on figuring out how to upgrade.

You cannot upgrade a theme on wordpress.com. All the themes here have been adapted from the original versions for wordpress.org to run on our wordpress.com software.

Ummm, if you are talking about a wordpress.com blog, we cannot upload themes. What is under presentation > themes is all we get.
