File Upload Terms of Service

  I want to create a photo site, but before I do I want to know how things work legally with file uploads. Can someone direct me to the relevant section of the terms of service, because I couldn’t find anything on users’ intellectual property rights.

  What property rights are you worried about? As long as you have the copyright of the photos before you upload them, WP.com isn’t going to hang on to them or post them without your permission. The licence you grant them is the ability to publish them: that means on YOUR blog. That’s all.

  The relevant section is this:

  By submitting Content to Automattic for inclusion on your Website, you grant Automattic a world-wide, royalty-free, and non-exclusive license to reproduce, modify, adapt and publish the Content solely for the purpose of displaying, distributing and promoting your blog. If you delete Content, Automattic will use reasonable efforts to remove it from the Website, but you acknowledge that caching or references to the Content may not be made immediately unavailable.

  I have added the bit that gives you protection. What they are saying is that you give them the right to display your blog, show abstracts on pages such as “featured”, submit entries to search and image search etc. but not to do anything that is not for promotion of your blog or displaying your blog. They cannot take your images and sell them or anything.

  Thanks. That’s what I expected the ToS to say, but I wanted to be sure and couldn’t find it for myself. Thanks both :)
