Fraudulent DMCA takedown notices

I’ve been receiving DMCA takedown notices and have found out that the person listed is NOT requesting these. Somoene is taking a public name and info off a webpage and filling out Automattic’s form. Automattic is apparently not validating these.
I can see by the comments left on the forums that this is happening to other people as well.
Right now i’m being told my blog will be taken down next week due to these notices. I need someone to contact me to see if this will be resolved. Thanks.

I emailed that address and (email visible only to moderators and staff) both yesterday. No response or acknowledgement yet.

maybe someone who KNOWS the artist did it on their behalf–do you have permission from the photo/image copyright holder/artist????

These issues are not discussed on the forums. That’s why I asked this blogger to contact Staff by email and it’s also why I tagged the thread for a Staff follow-up.

I would have but i’m not comfortable signing that i accept service of process from someone who didnt sign legally in the first place. I know that for fact.

If the complainant does not hold copyright they cannot claim their copyright has been violated because unless they are the copyright holder they have no legal ground to stand on.

P.S. I anticipated this kind of discussion and that’s why I was hoping Staff would choose to deal with this issue off the forums ie. by email.

I’m going to close this thread. The counternotice is the way to proceed if the original notice is not valid in your opinion.
@timethief – I provided an answer so others wondering about DMCA process would see that the counternotice is the next step. Volunteers get upset at us when we don’t give answers in public when we can, so going for the middle-ground.
