  No. External themes cannot be added to a wordpress.com blog; they are only for WordPress.org blogs. Get your money back.

  If they do refunds for this, what would stop me from getting my money back, saving the theme on my computer and using it on a WordPress.org?

  Nothing until they catch you – if you are on the internet, search engines can find the theme – they could have your site taken down and you can’t get a lawyer to take your phone call for the cost of a theme – let alone answer the lawsuit for theft of property – is it really worth the risk?
