Is this okay?

    Do wordpress allow blogs like Curicura that post (not host) TV shows? And maybe movies and anime. They post only the links or embedded video, they don’t host it themselves. Just curious ;)

    It depends on whether or not the copyright holder has authorized it. Illegal downloads will get your blog deleted like THAT. Links to illegal downloads will get your blog deleted just as fast.

    How about streaming? It’s not downloading, it’s watching from the internet.

    It’s illegal and still falls under copyright violation and will still get your blog deleted.

    You are only allowed to have stuff on your blog that the copyright holder has said is okay to distribute. Doesn’t matter HOW you distribute it, whether streaming or downloading. Also, I don’t think I know any livestreaming software that works with WP.com.

    Okay but how about if I make it a discussion blog for TV shows, where I post a link to watch it, then talk about it?

    If you post a link to something that is NOT legally posted on the internet, you are still facilitating the downloading or viewing of copyrighted content and it is still illegal.

    If the network broadcaster themselves posts it on their own website ( NBC, CBS, ABC, HBO etc.) for people to view, and you link to it there, then that would be OK because it is THEIR show.

    Why don’t you just blog, you know, LEGAL stuff? If your intention is to facilitate access to illegal material, not only will your blog get deleted but you might face charges. Don’t do it.

    Even if you self-host a blog, the TOS at the web host won’t allow it either, so you can get your blog deleted there as well.

    What if they link to Hulu, IMDB, or Youtube? I link to Youtube occasionally showing whatever clip of the person I’m talking about.

    Copyrighted stuff is deleted from youtube on a regular basis, and I know of instances where it was the blogger that embedded a video that got hit by the copyright violation notice prior to it being removed from youtube.

    The thing is, you can keep piling on “well what if I did this” but the bottom line is if they come after you it may be costly.

    Anyone that wants to take those chances is welcome, but don’t complain if you get whacked.

  • The question of whether or not it is legal to link to illegal (or dubious) material that is hosted elsewhere is still open. Lawyers will be arguing about it for decades.

    Here’s what I can say for certain:

    1. Ultimately you are responsible for what you post, and you’ll be the one who suffers any consequences.

    2. Lawyers routinely issue DMCA infringement notices against WordPress.com posts for linking to material hosted elsewhere (torrents, rapidshare downloads, youtube videos).

    3. Like all US-based hosting companies, WordPress.com is legally required to remove posts that are the subject of a DMCA notice – even if we think that notice might be unfair or unreasonable. That’s not our choice, it’s the law, and you’ll get the same treatment anywhere else.

    4. If you are the subject of a DMCA notice that you think is invalid or unreasonable, there is a specific procedure for you to follow to challenge it. Only you can do that, WordPress.com can’t and won’t do it for you. That’s the only legal way to re-publish material that was taken down as a result of a DMCA.

    5. Handling DMCA notices is time consuming, expensive and risky. If you are a repeat offender (or a first-timer with a blog full of stuff that looks like it will attract more DMCA notices) we will most likely shut down your whole blog rather than deal with a flood of them one by one. Again, you’ll get the same treatment anywhere else.

    In short: it’s your responsibility to know your obligations and assess your own risks. Questions like “is x legal” are, sadly, very hard to answer these days. A better question to ask yourself is, how confident am I that what I am doing is safe? If you haven’t investigated the risks yourself, the answer can only be “zero”.
