If the image you upload is larger than is going into the post, say 500px square and you insert it into the post or page at medium (300px square) wordpress creates a new “medium” sized image and the transparency is not kept on that image wordpress inserts. Same for a thumbnail.
What you have to do is to upload the image at the exact size it is going to be inserted into the post or page. If you want it to be medium sized, then make the image 300px wide. If you want it as a thumbnail, then make it the the size your them uses for a thumbnail before uploading it. If you want it full width of the posting area, create an image the width of the “full-size” image your theme uses before uploading it.

no good its still changing the background, I tried deleting and re-uploading the file and still white at 100% unchanged

If the image is being resized by WordPress when you insert it then the transparency will be lost. Go to your media library and get the URL of the original image you uploaded and put it here in the forums.

I have solved it by changing the template, I may stick with this as a solution.
I’ve done this before, wasted loads of time finding the fault and realised when I got there it was located in a branch and not an integral part of the process hence wasting the time invested.
It may be the template CSS and by a simple theme change solved it, so it isn’t the images after all!
Yes it would be interesting to locate the fault but ultimately a waste of time as it would only pertain to the template.
thanks for the help but I think things are simpler this way,. -

For the record, the solution in Koi would be to change the image code from this:
<img [etc.]
to this:
<img style="border:none;background:transparent;" [etc.]
