No DOCTYPE for Spectrum theme

I’ve configured a site using the Spectrum theme, but it does not include a DOCTYPE and isn’t validating.

<http://bit.ly/e0mbMe>This appears to be causing incorrect rendering on older browsers.
Is this deliberate? If not, can it be changed?

It does have a doctype as shown below. It is HTML5 actually.
<!DOCTYPE html>The only error being reported is that there is an obsolete attribute used in the head section.
