Please HELP! Someone is impersonating me on WP.com!
-
Someone created a blog about me using my name as the profile name and then they wrote a bunch of negative defamatory content about me as if it was by me.
I have contacted WordPress and Automattic with proof that it was not me and filed multiple abuse complaints but they are saying I need a U.S. Court Order to get it removed.
I can’t afford a lawyer and do not know how I can file a lawsuit myself and I don’t even know who to sue because I don’t know who it was that wrote the blog. I have tried googling the problem and can’t find any help.
WordPress is just “washing their hands” of the issue and saying they are “not in a position to arbitrate the validity of identity or defamation.” There is nothing to arbitrate! I have proof that this page is about me, was written as if it were by me, but it was not! I even submitted proof of my identity. It is a clear violation of their user guidelines! Why won’t they delete it? What can I do?

We Volunteers cannot help with this issue which ought not to be dealt with on a public forum available to all with internet access. If you wish to report a blog to Terms of Service Staff then please follow the instructions for reporting a blog.

Thanks, timethief, but I have done that multiple times and have not received support.
This blog is a clear violation of the WP terms of service and user guidelines and I have pointed that out via the usual channels. They have done nothing.

You can easily obtain a court order yourself even without a lawyer. Go to the courthouse and ask the clerks for help. That’s what they’re there for.
Or go to your local university’s law school; their students have volunteer hours to help people with this sort of thing. There are lots of free legal advice organizations around, some local and some digital. Have ALL of your documentation, including the responses from WP.com, handy when you contact them.
-
Actually, you can’t. I’m not sure if you’ve ever tried to obtain a court order, but it’s not as simple as walking down to the courthouse with a bunch of printed out emails.
-
Yes, I have.
If you disagree, and you are not willing to contact the free resources I pointed you to, then we are at the ultimate limit of what we can/could do for you, and there’s no reason to continue to post in the thread.

These guidelines are intended for those seeking information about a WordPress.com user, or looking to take action against a resource hosted on our network. https://en.support.wordpress.com/disputes/legal-guidelines/

You didn’t point out any free resources, Raincoaster. You told me “go to your local university” and that there are “lots of free legal advice organizations” which is totally SUPER helpful.

WordPress Terms of Service, https://en.wordpress.com/tos/ : “Responsibility of Contributors. By making Content available, you represent and warrant that your content does not violate these terms or the User Guidelines.”
WordPress User Guidelines: “Impersonation.
Don’t claim to be a person or organization you’re not. (Parody and satire are ok though!)” -
Then, as I said, we are at an end of the assistance we can provide you. You’re welcome.
Are you somehow under the impression that we fellow bloggers create and administer these terms of service?

I already posted this above but I’ll “play it again Sam”.

I also already posted this above, but I’ll also “play it again, Sam”:
I already went through the usual channels and have received ZERO assistance aside from telling me that I need to hire a lawyer and then have a judge issue a written court order in a court of law to get wordpress to delete a blog by someone who was obviously impersonating me that took 5 minutes to write.

You have already contacted staff, according to your own statements here. Their email is support@wordpress.com if you want to continue not to make progress, but continue it directly with them instead of with volunteers in the forum.
