Plugin infringement on WordPress.org’s terms and requirements

Hi!
Does selling a premium version of a plugin, even if it is not hosted on the WordPress.org repository, gives the right to said plugin/editor to overcome guidelines and rules set by WordPress? ex: to hijack the admin dashboard with undismissible notifications, or insert malicious code.
Some editors believe that once you enter into a private contract with them, and download and install a plugin from a 3rd party source (that still requires WP to operate, though), WP’s terms and plugin guidelines no longer apply: https://developer.wordpress.org/plugins/wordpress-org/detailed-plugin-guidelines/
I believe that selling a premium version of a plugin, even if it is not hosted on the WP plugin directory, does not give the right to an editor to overcome guidelines and rules set by WordPress. As long as a plugin relies on a content management system to operate, it is subject to the guidelines of the CMS, whatever they are.
What’s your opinion on that?
