Post Publish after validation in Ajax and jQuery

  Hi
  I modified the publish action that If certain cafeteria is full fill then only publish the code.
  To do that I just jQuery on public click event and call a function to check certain condition if is true then post else not.

  Now every thing is fine only it is left in draft instead of immediate publish.

  Please help me
