Tax settings

    Maine tax applies to items delivered in the Maine. If delivered out of state no tax applies. This being said, I’ve set tax to use the shipping address and not the billing address because some people order my products for delivery in Maine even though their billing address is out of state.
    The issue I have is that a customer purchased a virtual download from his home in massachusetts and he was charged Maine tax because he only filled out the billing address. Is there a way to default to billing address if shipping address is not filled out?
    or is there a way to make the shipping address required for tax purposes on a virtual product?
