Regardless of upgrades removing footer credit links is a terms of service violation. Removing footer credit links creates the false impression that you created the theme and that you host your own blog, when that’s clearly not the case at all. It’s a ToS violation to remove the footer credit links.
Though changing the footer text is not allowed, it’s possible to add your own text to the footer area using CSS if you have purchased the Custom Design upgrade. In it you can incude styling credit if you have done any styling and/or a copyright.

http://en.support.wordpress.com/custom-design/custom-fonts/If you purchase the upgrade you can use this link https://en.forums.wordpress.com/forum/css-customization#postform so you can copy and paste your text into a thread that will appear in the CSS Forum where you will get the help you need.
Otherwise if all you want to include is a copyright many bloggers do that by including a copyright notice in a text widget.

Is it still illegal if you decide to host the blog yourself? For example download wordpress from wordpress.org and host it on your own. No matter what even if you delete it from the footer the credit is still given in the code if someone were to inspect the elements.

If you hire a web host and set up your own self host WordPress.ORG install then you can shop for a theme that the designer allows you to edit the footer on. WordPress.COM and WordPress.ORG are completely separate and have different logins, features, run different versions of some themes with the same names, and have separate support forums. Read the differences here > http://en.support.wordpress.com/com-vs-org/
If you don’t have a username account at WordPress.ORG click http://wordpress.org/support/ and register one on the top right hand corner of the page that opens, so you can post to the support forums there and get advice form bloggers who self host.
