Hi there,
Premium themes have to be removed by Staff or transferred to another WordPress.COM hosted site of yours before the site they are on currently can be deleted. Deleting a site with upgrades https://en.support.wordpress.com/delete-site/#deleting%C2%A0a-site-with-upgrades
If Staff removes the theme for you, you won’t be able to get it back. And, if you delete the site, its name will not become available again, so do not use that option to “start over”. If you’ll confirm you understand that, Staff will act for you.

If no upgrade was purchased then why is a refund expected?
What is the exact URL starting with http:// of the site you referring to please?

If that is the site in question, it is not on our WordPress.COM servers. You are posting to the wrong support forum.
WordPress.COM and WordPress.ORG are completely separate and have different username accounts, logins, features, run different versions of some themes with the same names, and have separate support documentation and separate support forums. Your account does not own any upgrades on WordPress.com and has never bought anything from us. The only site in your account is http://livingthesweetstuff.wordpress.com and is on the free plan.
If you have another site, please provide the address and I can take a look.
