we are in a contract for the next 6 months and they have our domain. I wanted to build a website in the meantime so that I can cancel that account when it expires. Can I start building a website without a domain at this time?

In the setup process, you can choose to use the free “wordpress.com” address instead of connecting a custom domain, and then connect your existing domain at a later date.

You did not mention it but what is the URL of the site you have currently? Do you wish to import the contents of that site here? Even if the domain is not able to be transferred at this time, it is possible to use the domain connection option (provided by upgrading to any of the plans listed here) to connect your custom domain to a site you create here, even if you are prevented from transferring the domain at this time.
