  I know a company that has built their own CMS, using wordpresses backbone and files. I am curious as to how legal that is

  While we aren’t able to offer legal advice/answers, note that the WordPress.org software is free and open-source, meaning anyone can use it and build their own tools with it. You can learn more about the WordPress.org software on this page: https://wordpress.org/about/

  It’s also worth mentioning that WordPress.com is separate from WordPress.org. WordPress.org is the core software that’s free for anyone to download and use. WordPress.com, that’s us, provides a hosted solution.
