Someone filed a False DMCA notice (copyright infringement); I’ve countered twice by filing out the proper form

    On 6/11/18, a person claiming to be me filed a false copyright complaint on a DMCA taken down notice. The impostor who stole my identity: 1) claimed to be me; 2) gave a disconnected phone number, 3) a non-existent address, and 4) a fake email address. Despite the fact that this impostor gave no proof of copyright or any true correct information, WordPress responded by taking down my original text. Meanwhile, WordPress has in its possession the original date of my publication: 11/29/15 – and the text appears in the Way-Back machine through the Internet Archives. I’ve filled out the counter-claim for a DMCA take-down action twice, but WordPress is not helping me to dismiss this false claim. Instead, WordPress keeps sending me emails saying that I need to file a counter-claim (which I’ve done twice), and that they are not responsible. So, basically, what they’re saying is: anyone can file a fraudulent DMCA notice without proof of a publishing date, and then, WordPress will automatically take down the real author’s original text without investigating the merits of the copyright infringement claim. There is no logic here whatsoever, and the take down action by WordPress was grossly unfair. Additionally, I’ve spoken to my attorney, but we can’t go after this impostor because all the contact information on the DMCA form is false. Why is it so difficult for WordPress to understand that this DMCA complaint is frivolous? If a copyright complaint has any merit – the complainant needs to legally prove his true identity and the original date of publication that supersedes all others. This has not happened in this case and and can NEVER happen since I’m the original author with the original publication date. This entire incident is simply baffling, and the attitude I’m getting is – you’re guilty until proven innocent!!!
