  Can I use DIVI theme from Elegant Themes, I have worked with this theme and am comfortable with it.

  With a free WordPress.com plan you can activate any of the free themes (or purchase a Premium theme) found here: https://wordpress.com/themes. Other WordPress themes you see around the Interweb such as Divi are designed for the WordPress.org software and can only be used here at WordPress.com by upgrading to the Business plan.
